Local Legal Requirements: We will need planning approval from the Council's Principal Planner Hayley Williams. We will need planning approval in order to change the use of our building from a pizza shop into a bait and tackle shop. We will also need to pay $660 per annum per service to the Department of Environment for the business refuse. The final legal requirement for our business is the Fish Habitat Protection Area (FHPA) Law. This law is set by the Minister of Fisheries and forbids people from fishing in the Kalbarri Blue Holes. This means that in we will not be able to fish for our live bait in that area.
State Legal Requirements:
A state legal requirement for a small retail business is to not have a sign stating ‘no refunds’, ‘No refund on sale items’ and/or ‘Exchange or credit note only for return of sale items’. This is because if there is serious damage to a product that is not the consumer’s fault, then it should be able to be returned. Though a sign that says ‘no refunds will be given if you have simply changed your mind’ is allowed.
Also telling a customer that a consumer guarantee does not exist, may be excluded or may not have a particular effect is unlawful, though you can display signage expressing rights under the consumer guarantees, but it is not compulsory. There can be a civil fine for misleading or incorrect information.
Another state legal requirement is to get a business contract. This contract is a legal binding agreement that we must get for different reasons. We will need a partnership agreement between us, leases of business property, employment agreements and sale and purchases of business agreements.
As a small retail business, we will have to get a certificate, which if qualified will be accepted quickly and free of charge. We will also be allowed to trade 24 hours a day, everyday of the year.
